Nick Heimlich: Super Lawyers Selection
Nick Heimlich has been selected to Super Lawyers more than once. If you’re comparing business litigators in San Jose, you’ve probably noticed that many attorney badges are paid directory listings. This one isn’t.
Other lawyers nominate the candidates, a research team scores them, and no more than 5 percent of a state’s attorneys make the list in a given year. Super Lawyers is a designation for top-rated practicing attorneys selected through an extensive evaluation process. Nick was awarded this distinction for 2022 – 2026.

How Does The Super Lawyers Selection Work?
The process runs once a year, separately in each state.
Peer Nomination
Super Lawyers asks attorneys to nominate lawyers they’ve seen in action, whether as opposing counsel, as co-counsel, or through referrals. A few rules keep it from turning into a popularity contest:
- Nobody can nominate themselves.
- A nomination from someone at the same firm only counts if at least one nomination from outside the firm matches it. Outside nominations are also worth more points.
- The research staff can add strong candidates who weren’t nominated.
Independent Research
Next, the research team scores every candidate on 12 indicators. These include verdicts and settlements, transactions, honors and awards, special licenses and certifications, position within the firm, bar activity, writing and speaking, and pro bono work. Some indicators count for more than others. Before anyone makes the list, researchers also check licensing and disciplinary status.
Peer Evaluation by Practice Area
The top scorers in each practice area form a blue ribbon panel. They rate the remaining candidates in their own field on a 1 to 5 scale. So business litigators get rated by business litigators.
Firm-Size Grouping and the 5 Percent Cap
Before final selection, candidates are sorted into four firm-size groups. A solo or small-firm attorney competes against other small firms, not against large ones. The final list is capped at 5 percent of the state’s attorneys.
What Does the Rating NOT Mean?
It isn’t a State Bar credential either. The State Bar of California runs its own legal specialization program, and the two aren’t connected.
It also doesn’t predict how your case will go. It reflects what other lawyers think of an attorney’s work and what’s on that attorney’s professional record.
What Does Repeat Selection Signal?
Nominations, research scores, and the candidate pool all reset every year, with nothing carried over. An attorney who shows up year after year has been re-nominated and re-scored from scratch each time.
That counts for more in business litigation than it might in other practice areas. Contract, partnership, and franchise disputes often settle, sometimes before anyone files a complaint, and those outcomes don’t leave a public record you can look up. There’s no scoreboard. Recognition from lawyers who watched the work is one of the few outside signals you get.
It’s still one data point. Look at it next to case results, and talk with the attorney about your actual dispute.
